Digital Recording
The Maricopa County Recorder's Office is
capable of receiving and recording documents in a digital format. Currently
according to ARS-11-461, C. The recorder may accept a digitized image of a recordable instrument for recording
if it is submitted by a title insurer or title insurance agent as defined in
section 20-1562, by a state chartered or federally chartered bank insured by the
federal deposit insurance corporation, by an active member of the state bar of
Arizona, by an agency, branch or instrumentality of the federal government, a
"trusted submitter" or by a governmental entity and the instrument from which
the digitized image is taken conforms to all applicable laws relating to the
recording of paper instruments. A
"trusted submitter" is defined as; a person or entity that has entered into a
Memorandum of Understanding regarding digitized recording with the county
recorder in the county in which the digitized recording is to be submitted.
What does this mean to you? If you fall into any of the above described
categories you too can record your document in a digital format with the
Maricopa County Recorder's Office.
There is no additional charge to record documents in a digital format. In order
to take advantage of this program you need access to the internet and a scanner
that will allow you to send multi-tif group 4 images.
The Recorder's Office offers high volume recording customers a VPN
(Virtual Private Network) connection for security and for low volume recording
customers, our own in-house program called Digital Recording Upload Program.
All connections are password protected. All documents received in a digital
format will be reviewed and if accepted, recorded within a few hours. In
addition to this, we provide you a web page to verify your order status and a
link to the recorded image. This too is password protected.
These are just a few of the benefits that we provide to our
digital customer.
In order to participate in the digital recording program you must first open an
account with us. For your convenience we have provided you a link (please see
below) to the necessary account applications. All three forms must be completed.

provide you with instructions on how to proceed with digital recording.
Memorandum of Understanding
Maricopa County desires to offer the recording of real property documents by
electronically receiving and transmitting documents electronically in
substitution for conventional paper based documents and to assure that
transactions are not legally invalid or unenforceable as a result of the use of
available electronic technologies for the mutual benefit of the parties of the
transactions. In order to participate in the digital recording program you are
required to submit a signed memorandum of understanding along with your account
application. Access to the memorandum is provided below.
